Pratik Shah and Tejinder Singh will discuss the most important issues affecting the Court today, particularly the impact of the vacancy on the Court and its ability to decide cases in the current and upcoming term. They will address some of the recent decisions issued by the Court and how the Court is impacted by the absence of a ninth justice: Zubik v. Burwell, Friedrichs v. California Teachers Association, and Spokeo, Inc. v. Robins. They will address some of the prominent outstanding cases, including a brief summary with predictions for outcomes: Whole Women’s Health v. Hellerstedt, US v. Texas, and Fisher v. UT Austin. As we are in Delaware, there will be a discussion of Cuozzo Speed Technologies, LLC v. Lee. Finally, we will end with a brief discussion of the nomination and confirmation process for Judge Merrick Garland
